Lecture by Prof. Ningyan Wu from State Intellectual Property On 1st Oct, the new “Patent Law” had come into effect. To let teachers and students get to know what’s the changes in new law, Prof Ningyan Wu from State Intellectual Property was invited by divisions of science and technology of Unviersity of Science & Technology Beijing(USTB) to give a lecture on new “ Patent Law”.
Prof. Wu provide a brief background introduction at the very beginning: since great changes have taken place both in China and international sociaty, it is the time that China need to improve current patent law which has not go along with rapid development of China patent works. The new patent law is aiming at defending Chinese interests, maintaining current basic patent work structure, keeping line with internaitonal patent system develpoment trend. The legislative objetives of this new law is to pushforward technological development and creation.
Prof. Wu explained the main differences from two aspects:
Ⅰ. Main improving points in new patent law;
Ⅱ. More specific rules on important items, including Requirements for Grant of Patent Right, Requirments for against application for Grant of Patent Right, Requirements for Grant of the Patent of Design, Adjustment of repeating Grant of Patent Right, Adding some rules on situations of no right being granted, Adding several situations of exceptions of patent infringement, Re-stipulate compulsory patent license, improving evaluation report on patent right, Cancelling regulaitons on agencies that handle foreign patent-related affairs. Contrasting with the old law, through case analysis, Porf. Wu give a clearly explanation on differences between new patent law and the old one, which made all attending teachers and students know much more about the spirit of the new law.
After the lecture, Prof. Wu answered some questiones asked by teachers and students and exchanged views with them. Through this lecture, every teachers and student came to understood the content of new law as well as the law spirit more deeply, which would be very useful for their furture work and study.
